These Terms of Service ("Terms") govern your access to and use of Morphora, including the web application and any related services, content, features, and communications (collectively, the "Service").

The Service is operated by The Hope Harvest Group LLC, Tampa, Florida, USA ("The Hope Harvest Group," "we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Morphora enables users to create and manage a personal catalog of plants, including plant records, photos, notes, messages, and other information or materials submitted through the Service.

We may modify, suspend, discontinue, or update all or part of the Service at any time. We do not guarantee that every feature, item of content, or part of the Service will always be available, error-free, secure, or uninterrupted.

The Service is intended for personal and lawful business use. It is not intended to provide professional horticultural, medical, safety, agricultural, pest-control, or other expert advice. You are responsible for decisions you make regarding your plants, property, pets, people, products, and activities.

2. Eligibility and Accounts

You must be at least 16 years old to create an account or use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

You must provide accurate, current, and complete registration information, including your name and email address, and keep it updated.

You may not create an account using false information, impersonate another person or organization, share account credentials in an unauthorized manner, or use another person's account without permission.

3. Free and Paid Plans

Morphora may offer a free plan that limits the quantity of plants, records, storage, features, or other functionality available to a user. We may also offer paid monthly subscription plans and lifetime-access purchase options.

The plan details, features, restrictions, pricing, and payment terms shown at checkout or within the Service are incorporated into these Terms.

We may change plan offerings, features, and prices prospectively. Any price change for a recurring subscription will take effect only after any required notice and at the start of a subsequent billing period, unless otherwise stated or permitted by applicable law.

4. Payments and Renewals

Payments are processed by third-party payment processors. We do not intend to store your complete payment-card details ourselves. Your payment information is handled according to the payment processor's terms and privacy practices.

By purchasing a paid plan, you authorize us and our payment processor to charge the applicable fees, taxes, and other disclosed charges to your chosen payment method.

For monthly subscriptions:

Cancellation stops future renewals but does not ordinarily refund charges already paid for the current billing period, except where we agree, a separate refund policy provides otherwise, or applicable law requires otherwise.

We will present automatic-renewal terms clearly at or before checkout. A "lifetime" purchase means access to the paid features designated as lifetime features for the purchased account while Morphora continues to make those features generally available. It does not guarantee uninterrupted operation forever, future features, compatibility with all devices or services, or continued operation of the Service in the event of a business closure, material redesign, legal requirement, security necessity, or other reasonable operational change.

We may deny refund requests involving misuse, fraud, chargeback abuse, material violations of these Terms, or requests made after a reasonable period following purchase. A refund does not prevent us from suspending or terminating an account for a violation of these Terms.

"User Content" means material you submit, upload, create, store, transmit, or otherwise make available through the Service, including plant records, photographs, notes, files, messages, and other content.

You retain ownership of your User Content. However, to operate and improve the Service, you grant The Hope Harvest Group a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, modify solely for technical formatting or display, back up, transmit, and display your User Content as necessary to provide, secure, maintain, troubleshoot, support, and improve the Service.

You represent and warrant that:

The Service, including its software, design, branding, logos, text, graphics, interfaces, compilations, and other materials, is owned by or licensed to The Hope Harvest Group and is protected by applicable intellectual-property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purposes. These Terms do not transfer ownership of the Service or any of our intellectual-property rights to you.

"Morphora," the Morphora logo, and other marks used in connection with the Service may be trademarks or trade dress of The Hope Harvest Group. You may not use them without our prior written permission.

9. Account Suspension and Termination

You may stop using the Service and request deletion of your account at any time by contacting thehopeharvestgroup@gmail.com, or by using the "Delete my account" option inside the app.

We may suspend, restrict, remove content from, or terminate your account or access to the Service at any time, with or without notice, to the extent permitted by law, including if we reasonably believe you have violated these Terms, created risk or legal exposure for us or others, engaged in fraud or abuse, failed to pay applicable fees, or if discontinuation is necessary for security, technical, operational, or legal reasons.

Termination or suspension may result in loss of access to your User Content and account data. To the extent permitted by law, we are not responsible for retaining User Content after termination. However, data may remain in backups or records for a limited period as described in the Privacy Policy, for legal compliance, security, dispute resolution, and legitimate business purposes.

We will not claim ownership of your User Content merely because your account is terminated. However, content may be deleted, disabled, or retained where reasonably necessary to enforce these Terms, comply with law, protect rights and safety, resolve disputes, maintain records, or operate backups.

The Service relies on third-party service providers for hosting, authentication, payment processing, analytics, communications, data storage, security, and related functions. Your use of certain features may also be subject to third-party terms and privacy policies.

We are not responsible for third-party services, websites, products, content, availability, security, or practices. You should review the terms and privacy policies of relevant third parties.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE HOPE HARVEST GROUP DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION.

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT YOUR CONTENT WILL NEVER BE LOST OR ALTERED, OR THAT THE SERVICE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow certain warranty exclusions, so some of these limitations may not apply to you.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE HOPE HARVEST GROUP AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) US $100.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Hope Harvest Group and its members, managers, employees, contractors, agents, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from or related to your User Content, your use or misuse of the Service, your violation of these Terms, or your violation of another person's rights.

14. Governing Law and Venue

These Terms and disputes arising out of or relating to them are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.

Unless applicable law requires otherwise, you and The Hope Harvest Group agree that any dispute must be brought exclusively in the state or federal courts located in or serving Tampa, Florida, and each party consents to the personal jurisdiction and venue of those courts.

Nothing in these Terms limits consumer protections that cannot be waived under the law applicable to you.

15. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will provide notice by posting updated Terms, updating the effective date, sending an email when appropriate, or providing notice through the Service.

Your continued use of the Service after the effective date of updated Terms means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
